Return, Cancellation, and Withdrawal Policy

WARNING: In accordance with the relevant law, please print and read this text in 12-point bold font. Additionally, every buyer who makes a purchase on our website is deemed to have read and accepted all clauses of this document, which has been prepared in compliance with Law No. 6502 on Consumer Protection and other relevant regulations, without the need for further notification.

1. DEFINITIONS

BUYER The individual making a purchase on Elvan Lapis’ website www.elvanlapisjewellery.com. The address and contact information provided by the buyer will be considered valid.

Courier Company The contracted courier or logistics company responsible for delivering the product to the BUYER and handling returns to the SELLER.
Platform The website owned by the Seller, accessible at www.elvanlapisjewellery.com.

2. RETURN, CANCELLATION, AND WITHDRAWAL CONDITIONS

  • The Buyer acknowledges acceptance of the Preliminary Information Form and Distance Sales Agreement by placing an electronic order through this website.
  • The Buyer has the right to withdraw from the contract within 14 (fourteen) days from the delivery date of the purchased product to the Buyer or the designated recipient, without any legal or penal liability and without providing any justification, by notifying the Seller through the contact details provided in the Definitions section.
  • The Buyer who has purchased a product in installments may exercise the right of withdrawal within 7 days from the date of receipt by notifying the Seller, without incurring any legal or penal liability and without providing a justification.
  • Cancellation requests for consultancy services must be submitted in writing to the Seller through the communication channels specified under the Parties section, before the scheduled consultancy date.
  • Cancellation requests for workshop registrations must be submitted at least 5 (five) days before the scheduled workshop date via the communication channels specified under the Parties section.
  • For all products purchased from elvanlapisjewellery.com and intended for return, the right of withdrawal can only be exercised if the product is carefully preserved by the Buyer and remains unopened, undamaged, and unused in its original packaging.
  • Promotional or campaign products provided as gifts must also be returned together with the returned product.
  • The Buyer should inspect the goods before accepting delivery from the courier company. Any damaged or defective goods (e.g., crushed, broken, torn packaging) should not be accepted. Once the Buyer accepts the delivery, the product is deemed to be received in a damage-free and intact condition.
  • If the product is found to be defective, the Buyer may:
    1. Return the product and cancel the contract.
    2. Keep the product and request a discount proportional to the defect.
    3. Request a replacement with a non-defective product, if possible.

3. EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

According to Article 15 of the Regulation, the right of withdrawal cannot be exercised for the following products:

  • Products that are not suitable for return due to their nature.
  • Products customized according to the Buyer’s requests or personal needs.
  • Natural stone products, where variations in size and tone may occur, are not eligible for return due to such differences.
  • Products produced specifically for the Buyer with modifications or additions.
  • Products that come into direct contact with the body and are sensitive in terms of hygiene.
  • Perishable goods or items with an expiration date.
  • Cosmetic and personal care products.
  • Digital products provided electronically, which cannot be returned once shared with the Buyer.
  • Products that have been unsealed (e.g., packaging, seals, tapes) and are no longer suitable for return due to health and hygiene concerns.

4. REFUND POLICY

  • Once a returned product reaches the Seller, the refund will be processed within 14 days using the original payment method.
  • If the returned product has been damaged due to the Buyer’s fault, the Buyer is responsible for compensating the Seller accordingly.
  • If the Buyer’s return causes them to fall below a campaign limit, any discounts received from the campaign will be voided.

5. DISPUTE RESOLUTION

  • The Buyer may submit complaints or disputes to the Consumer Arbitration Board or Consumer Court in their place of residence or where the product/service was purchased, within the monetary limits set by the Ministry.
